16. Dispute Resolution
16.1 Informal Resolution

16.2 Binding Arbitration
If the parties are unable to resolve a dispute informally, such dispute shall be finally and exclusively resolved by binding arbitration administered in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Weber County, Utah, or at another mutually agreeable location. The arbitration shall be conducted in the English language by a single arbitrator mutually selected by both parties. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
16.3 Class Action Waiver
You agree that any dispute resolution proceedings shall be conducted only on an individual basis and not in a class, consolidated, or representative action. You hereby waive any right to participate in a class action lawsuit or class-wide arbitration against the Company or the Developer.
17. Force Majeure
Neither party shall be liable for any failure to perform or delay in performing any obligation under these Terms of Service if such failure or delay is due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, embargoes, government acts or regulations, fires, floods, earthquakes, epidemics, pandemics, strikes or other labor disputes, utility or telecommunication failures, or internet service interruptions. The affected party shall promptly notify the other party of the force majeure event and shall use commercially reasonable efforts to resume performance as soon as practicable.
18. Severability
If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the parties' original intent as closely as possible. These Terms of Service, together with our Privacy Policy and any applicable project-specific agreements, statements of work, or service contracts, constitute the entire agreement and understanding between you and Fun Fit Oasis, LLC concerning the subject matter hereof and supersede all prior or contemporaneous negotiations, discussions, agreements, representations, and understandings, whether written or oral, relating to the subject matter. Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
